from Simmons regarding the “safety issue” with their changing
pad:

Contour Pad FR Compliance Issue

? We recently received a notice
from the State of California?s Bureau of Home Furnishings and Thermal
Insulation (the Bureau) that two models of contour pads purchased from two
different Toys R Us stores in California did not meet the State?s
requirements for foam filling materials, known as Technical Bulletin 117 (TB
117). TB 117 is a test unique to California and is a flammability test relating
to the polyurethane foam used in the product and is not a test of the finished
product as used by the customer.


? The contour pads, as supplied to consumers, passed the flammability
testing requirements for finished products, known as Technical Bulletin 116 (TB
116).

? While we work with
the Bureau and our foam suppliers to understand the problem with the foam, the
State has ordered us to stop selling the two models of contour pads in
California. The Bureau has not ordered a consumer-level recall in California.
We are not subject to a nationwide stop-sale order or a consumerlevel recall
anywhere,

? We have contacted
Toys R Us and they have asked us to stop supplying the two contour pads to
their stores nationwide until further testing is complete. This is not
required by any government agency, but is a matter of company policy.
Simmons is confident that all of its contour pad products are safe and that
these problems with the foam do not indicate that there is any increased fire
risk. For any customer who purchased one of these two models of contour pad
who is not satisfied, Simmons is happy to replace the contour pad with a
reformulated product as soon as soon as it?s available or with another
contour pad product that is not subject to the stop-sale order.
